Conwest Developments Ltd., including all companies and partnerships that form part of the Conwest Group of Companies (collectively, “Conwest”, “we”, “us”, “our”), is committed to protecting the privacy of the Personal Information of its employees, customers, suppliers, and other stakeholders across our business activities, including our websites, project websites, and related digital properties. We value the trust of those we deal with, and of the public, and recognize that maintaining this trust requires that we be transparent and accountable in how we treat the information that you choose to share with us.

During our various projects and activities, including through our websites, project websites, and related landing pages, Conwest frequently gathers and uses Personal Information (defined below). Anyone from whom we collect such information should expect that it will be carefully protected and that any use of, or other dealing with, this information is subject to their consent as described in this Policy and applicable law. Conwest’s privacy practices are designed to achieve this.

Conwest reserves the right to anonymize and aggregate the Personal Information that you provide to us and to use the resulting anonymized, aggregated data in any way that we determine is appropriate. This Privacy Policy (“Policy”) does not apply to anonymized, aggregated data from which an individual cannot be identified, directly or indirectly. This Policy also does not apply to Business Contact Information (defined below) to the extent that it is collected, used, or disclosed solely to contact individuals in their business or professional roles; other uses or disclosures of Business Contact Information will be subject to this Policy.

By accessing and browsing our websites, including our project websites and related landing pages, or otherwise providing your Personal Information to us, you acknowledge that we may collect, use, and disclose information about you as described in this Policy and as permitted or required by applicable law. Where required by law, we will obtain your consent before collecting, using, or disclosing your Personal Information, including through certain cookies and similar tracking technologies used on our websites. We may update this Policy from time to time. When we do, we will post the revised version on the applicable website and update the “Last updated” date. Your continued use of our websites or continued provision of Personal Information after any update will be subject to the revised Policy, to the extent permitted by applicable law.

Definitions

In this Policy:

Business Contact Information” means your business position, name or title, and your business address, phone and fax numbers and e-mail address.

Personal Information” means any information about an identified individual, or an individual whose identity may be inferred or determined from the information, but does not include Business Contact Information when used to contact you in your work capacity.

How We Collect Personal Information

Information that you provide

Conwest uses only fair and lawful methods to collect Personal Information. Conwest collects only the Personal Information that is reasonably necessary for the purposes identified in this Policy. Conwest collects Personal Information that you provide to us in writing, electronically (including through our websites, project websites, and landing pages), verbally over the

telephone, or in person. We collect information when a person voluntarily completes an online form, submits a project inquiry or registration, event registration, or online survey. We may also seek to collect email addresses from time to time, but you are not required to provide your email address; however, if you choose to do so, you may indicate that you do not wish to receive unsolicited electronic communications from us.

If you complete a form, submit a project inquiry or registration, event registration or online survey via our websites or otherwise, you may be asked to supply one or more of the following types of information:

  • Name
  • Company Name
  • Email Address
  • Phone number

Automatic Collection of Information Through Our Websites

We and our third-party service providers, including analytics providers, advertising partners, social media platforms, and media partners, may automatically collect certain information about your use of our websites, including our project websites and related landing pages, through cookies, web beacons, pixels, tags, scripts, software development kits, session replay tools, and similar technologies. These technologies may be placed or deployed by us or by third parties acting on our behalf. The information collected may include your IP address, browser type, device identifiers, operating system, approximate geolocation derived from IP address, pages viewed, links clicked, dates and times of visits, referring and exit pages, search terms, interactions with content, form interactions, and information about the advertisements or communications you have viewed or engaged with. We use Google Analytics and may use other analytics and advertising technologies to understand how our websites are used, to manage and improve our websites and campaigns, to diagnose technical issues, to understand the effectiveness of our marketing and advertising, to measure leads and conversions, and to deliver, facilitate, and evaluate advertising and content that may be more relevant to your interests, including retargeting, remarketing, and other interest-based advertising.

You may be able to control cookies and similar technologies through your browser settings, device settings, cookie consent tools made available on our websites, and industry opt-out mechanisms. Depending on the third-party services in use, you may also be able to opt out of certain analytics, conversion tracking, and interest-based advertising by adjusting your browser settings, using applicable platform privacy controls, or visiting the opt-out tools offered by the relevant third parties. Please note that disabling certain cookies or similar technologies may affect the functionality of our websites. Some of our websites, including project websites and campaign landing pages, may use third-party cookies, pixels, tags, and similar technologies provided by advertising networks, social media companies, analytics providers, and media partners. These technologies may collect information about your activities over time and across different websites, devices, and online services in order to provide analytics, attribute leads or conversions, understand audience engagement, tailor content, and support retargeting, remarketing, and other interest-based advertising. We may receive reports, insights, or aggregated results from these third parties in connection with those activities. Our websites and project websites may also contain links to plug-ins from, embedded content from, or integrations with third-party websites, platforms, applications, or services that we do not own or control. This Policy does not apply to the privacy, security, content, or practices of those third-party websites or services, and any information collected by them is subject to their own privacy policies and practices. We encourage you to review those policies before providing information to or interacting with any third-party website or service.

On-site video collection of Personal Information

We may install video cameras or other recording devices in the public access areas of our premises. We will post signs notifying individuals of the existence and purpose of these recording devices.

Other information

We may also collect other information when you use our services or websites, including our project websites, contact us for information, or respond to emails, newsletters, or promotional or information communications, including information about your interactions with our websites, landing pages, digital advertisements, and communications.

Using Personal Information

Our use of Personal Information is limited to the purposes described in this Policy unless we expressly tell you otherwise or as permitted or required by applicable law. We do not sell your Personal Information for monetary consideration.

We collect this information for the following purposes:

  • To present our websites, including our project websites and related digital properties, and their contents to you.
  • To fulfill the purposes for which you provided the information or that were described when it was collected, including responding to project inquiries and processing project registrations, or any other purpose for which you provide it.
  • To communicate with you regarding your inquiries for information, products, or services.
  • To provide services via our websites or otherwise.
  • To share information with you about Conwest, our websites, our projects, and our developments.
  • To improve our websites, products or services, marketing, and customer relationships and experiences.
  • To measure, analyze, or understand the effectiveness of our websites, project websites, content, marketing, and the advertising we serve to you and others, including through analytics, audience measurement, tracking tags, and conversion tracking.
  • For marketing, operations, and communications purposes, such as providing you with information about sales opportunities and employment opportunities, and to deliver, facilitate, and evaluate retargeting, remarketing, and interest-based advertising relating to Conwest, our developments, and our services.
  • For any other purpose with your consent.

You may opt out of certain uses of your information for marketing purposes by sending an email request to privacyofficer@conwest.com or contacting us as set out at the address provided below. You may also exercise choices relating to cookies, analytics, and similar technologies, including certain interest-based advertising controls, as described in this Policy. Unsubscribing from marketing emails will not by itself disable cookies or similar technologies used on our websites.

Transfers and Disclosures of Your Personal Information

Your Personal Information may be transferred between the entities in the Conwest group of companies and will be handled by those entities as described in this Policy. As a rule, we hold all Personal Information in strict confidence and only disclose it to fulfill the purposes for which you have provided it to us and for which we have your consent, or as otherwise permitted or required by applicable law. Except in limited circumstances, we do not reveal this information to anyone unless you have expressly or implicitly authorized us to do so, or as otherwise permitted or required by law. Conwest may disclose Personal Information if required or permitted by a law, court, administrative agency, or other governmental tribunal. When this occurs, we will not disclose more information than is reasonably required.

Should we undergo a fundamental business change such as the sale of one or more of our businesses, Personal Information that we hold may be transferred to the other parties to the transaction and their professional advisors as permitted under applicable law. In such cases, the Personal Information will be transferred subject to confidentiality restrictions and use of the information for the purpose of evaluating and completing the transaction and the ongoing operation of the business.

We may transfer Personal Information that we collect or that you provide as described in this Policy to contractors, service providers, and other third parties we use to support our business, websites, project websites, and marketing activities (such as hosting providers, analytics providers, search engine providers, customer relationship management providers, advertising technology providers, social media platforms, and advertising or media partners that assist us with website improvement, optimization, ad delivery, lead and conversion measurement, audience insights, and remarketing) and who are contractually obligated, where appropriate, to keep Personal Information confidential, use it only for the purposes for which we disclose it to them, and process the Personal Information in a manner consistent with this Policy and applicable law.

We may process, store, and transfer your Personal Information in or to a foreign country with privacy laws that may differ from those in Canada. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your Personal Information under the laws of that country. Whenever we engage a service provider, we require that its privacy and security standards adhere to this Policy and applicable Canadian privacy legislation.

Consent

By providing your Personal Information to us, you agree that we may collect, use, and disclose it in accordance with this Policy and as otherwise permitted or required by law. Depending on the sensitivity of the Personal Information, the purposes for which it is collected, and your reasonable expectations, consent may be express or implied, as permitted by applicable law. We will seek your consent for any collection, use, or disclosure of Personal Information for a purpose not previously identified, unless otherwise permitted or required by law. Where required by law, we will also seek your consent in connection with the use of non-essential cookies and similar tracking technologies on our websites.

If you need to provide us with Personal Information about other individuals (such as your employees, employer, supervisor, etc.), you represent and warrant to us that you will obtain

their consent where required by law prior to your disclosure to us of their Personal Information so that we may use and disclose the information for the specific purposes for which you made the disclosure.

Withdrawal of Consent

You may withdraw your consent to our collection, use, and disclosure of your Personal Information at any time, subject to reasonable notice and any legal and/or contractual restrictions. If you do withdraw your consent, we may not be able to continue to provide our goods or services to you. Please contact our Privacy Officer for more information. You may also change your preferences regarding cookies and similar technologies through the options made available on our websites or through your browser or device settings, subject to the limitations of those controls.

You may, at any time, ask us not to send you further marketing materials about our goods and services. If you do not wish to receive further invitations to events, you may unsubscribe or contact us at the address provided below and ask that we not contact you for these purposes. Opting out of marketing communications will not necessarily affect data collection through cookies and similar technologies or the delivery of interest-based advertising; those choices are addressed separately in this Policy.

Accuracy and Retention of Personal Information

We endeavour to ensure that any Personal Information provided to us and in our possession is accurate, current, and complete. If we become aware that Personal Information is inaccurate, incomplete, or out of date, we will revise the Personal Information. However, we do not actively update information of former contacts or employees and, for as long as we hold that information, we cannot assure that the information is accurate.

We keep your Personal Information only as long as it is required for the reasons it was collected. This period may extend beyond the end of your relationship with us in accordance with our document retention policy and practices and as necessary to satisfy any legal requirements. When we no longer require your Personal Information, we have procedures to securely destroy, delete, erase, or convert it into an anonymous form.

Protection of Personal Information

We endeavour to maintain appropriate physical, procedural, and technical security safeguards at our offices and information storage facilities designed to prevent any unauthorized access to, or loss, misuse, disclosure, or modification of Personal Information. This also applies to our disposal or destruction of Personal Information.

We further protect Personal Information by restricting access to those employees who need access to provide products, services, or information.

We audit our procedures and security measures from time to time to ensure that they remain effective and appropriate.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we use reasonable safeguards designed to protect your Personal Information, we cannot guarantee the security of Personal Information transmitted to our websites. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our websites.

Access to Your Personal Information

You have the right to access and review the Personal Information we hold about you, subject to any legal restrictions or exceptions. We will endeavour to respond to your request within a reasonable time. We may require you to provide sufficient information or documentation to verify your identity before providing you with access to your Personal Information. Where we are unable to provide access, we will provide reasons for the refusal, subject to any legal restrictions.

Despite our efforts, errors sometimes do occur. If you identify any Personal Information that is out-of-date, incorrect or incomplete, please contact us and we will make the corrections promptly. We will also use every reasonable effort to communicate these changes to other parties who may have inadvertently received incorrect or out-of-date Personal Information from us.

Children Under the Age of 13

Our websites, including our project websites and related landing pages, are not intended for children under 13 years of age. No one under age 13 may submit Personal Information to our websites. We do not knowingly collect Personal Information from children under 13 through our websites. If you are under 13, please do not use or provide any information on any of our websites or through any of their features, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn that we have collected or received Personal Information from a child under 13 without any consent required by law, we will delete that information. If you believe we might have information from or about a child under 13, please contact our Privacy Officer at the address below.

Privacy Concerns – Compliance and/or Contact

We will promptly respond to questions and concerns relating to our Personal Information handling practices and this Policy and do our utmost to resolve your concerns. In every instance, we will consider our obligations with respect to privileged information, as well as our separate obligations under applicable privacy legislation. We may need to ask you for Personal Information to verify your identity.
